Welcome to Complima, an AI-driven compliance auditing service provided by Complima ("we," "us," or "our"). By accessing or using Complima (the "Service"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
1. Nature of the Service
Complima is a software-as-a-service platform that uses artificial intelligence to scan uploaded documents, emails, and data files (e.g., PDF, TXT, CSV, EML, DOCX) for potential compliance risks related to regulations such as GDPR, CCPA, and HIPAA. The Service provides recommendations based on AI-generated analysis. These recommendations are for informational purposes only and are not certified, guaranteed, or legally binding.
- AI-Generated Outputs: All outputs, including flagged issues and suggested fixes, are generated by AI and may contain errors or inaccuracies. Complima does not warrant the accuracy, completeness, or reliability of these outputs.
- No Certifications: Complima holds no regulatory certifications or accreditations. Users are solely responsible for verifying compliance with applicable laws.
- Recommendations Only: The Service provides recommendations, not legal advice. Users must consult qualified legal or compliance professionals before acting on any recommendations.
2. User Responsibilities
- Account Usage: You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.
- Uploaded Content: You may upload files to the Service for analysis. You represent and warrant that you have the legal right to upload such files and that they comply with applicable laws. Complima is not responsible for the content of uploaded files.
- Compliance Verification: You are solely responsible for ensuring your compliance with all applicable regulations. Complima's recommendations do not guarantee compliance or protection against legal action.
3. No Liability
- Disclaimer of Liability: Complima, its affiliates, and its providers (including Google Cloud) shall not be liable for any damages, losses, or legal actions arising from your use of the Service, including but not limited to errors in AI-generated recommendations, failure to identify compliance risks, or any decisions made based on the Service's outputs.
- No Legal Accountability: You agree that no legal action may be taken against Complima for any outcomes related to the use of the Service, including regulatory fines, penalties, or data breaches.
- Use at Your Own Risk: The Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose.
4. Scan Result Storage and Deletion
- Privacy-First Processing: Your uploaded documents are processed in-memory only and are never stored on our servers or Google Cloud. Only the compliance scan results (identified issues and recommendations) are saved to our database.
- Scan Result Retention: Scan results are retained based on your subscription tier (30 days for Starter, 1 year for Professional, unlimited for Enterprise). You can delete scan results at any time from your dashboard.
- Deletion: Scan results are automatically deleted when the retention period expires or upon your explicit request. Once deleted, scan results cannot be recovered.
- Security: Scan results are stored in Google Firebase Firestore with industry-standard security measures. All data is encrypted in transit and at rest.
5. Subscription and Payment
- Pricing: Complima offers tiered subscriptions (e.g., Starter, Professional, Enterprise). Pricing details are available on our pricing page.
- Payment: Payments are processed via a third-party provider (Stripe). You agree to pay all applicable fees and taxes.
- Cancellation: You may cancel your subscription at any time. No refunds are provided for partial billing periods.
6. Intellectual Property
- Service Ownership: Complima owns all intellectual property rights to the Service, including its software, algorithms, and user interface.
- User Content: You retain ownership of uploaded files and data. Complima does not claim ownership but requires a limited license to process and analyze your files to provide the Service.
7. Prohibited Uses
You may not use the Service to:
- Upload illegal, harmful, or infringing content.
- Attempt to reverse-engineer, hack, or disrupt the Service.
- Use the Service for purposes other than compliance auditing.
8. Termination
We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms. Upon termination, your scan results may be deleted, and you will lose access to the Service.
9. Governing Law
These Terms are governed by the laws of Sweden. Any disputes shall be resolved in the courts of Sweden.
10. Changes to Terms
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
